PART ONE : INTRODUCTION

 

1. Legal Requirement

Adopting a publication scheme is a requirement of the Freedom of Information Act 2000 (FOIA).  The FOIA promotes greater openness and accountability across the public sector by requiring all public authorities to make information available proactively, through a publication scheme. 

‘Public authorities’ are defined in the FOIA and include universities, further education colleges and sixth form colleges’.

2. What is a publication scheme?

A publication scheme is a document which describes the information a public authority publishes or intends to publish.  In this context, ‘publish’ means to make information available routinely.  These descriptions are called ‘classes of information’.  The scheme is not a list of the actual publications, because this will change as new material is published or existing material revised.  It is, however, the public authority’s commitment to make available the information described.  The public authority must also make clear how the information described can be accessed and whether or not charges will be made.

3. The Model Publication Scheme for higher education

Anglia Ruskin University has adopted the Model Publication Scheme which has been prepared and approved by the Information Commissioner.  This scheme takes effect from 1 January 2009 and commits Anglia Ruskin University to make information available to the public as part of its normal business activities.  The information covered is included in the classes of information mentioned below, where this information is held by Anglia Ruskin University. Anglia Ruskin University has produced a Guide to Information which specifies the particular information it publishes, how it will be published and what charge, if any will be made. 

The classes of information will not usually include;

  • Information the disclosure of which is prevented by law, or exempt under the Freedom of Information Act, or is otherwise considered to be protected from disclosure.
  • Information in draft form.
  • Information that is no longer readily available as it is contained in files that have been archived or is difficult to access for similar reasons.

4. Anglia Ruskin University

Over the last 20 years, Anglia Ruskin University has transformed from a Higher Education College, to a polytechnic and it gained university status in 1992.

The mission of Anglia Ruskin University is to sustain and continue to develop, at a number of locations in the Anglia region, an institution of international standing and quality which serves the particular educational, economic and cultural needs of the region, so assisting its development and identity within the European and wider communities. 

We employ 1700 members of staff, have approximately 24,000 students and a turnover of around £120million.

We have two main campuses in Chelmsford and Cambridge, however, we also have links with over 25 partner institutions throughout the region and abroad. 

Our governance is subject to the Education Reform Act 1998, the Further and Higher Education Act 1992 and the Articles of Government. 

Anglia Ruskin University affairs are managed by two distinct bodies: the Board of Governors and Senate.  The Governors are responsible for overseeing the operational aspects of the University and Senate are responsible for academic standards.

5. Accessing Information in the Publication Scheme (the Scheme)

The majority of the information in the Scheme is available via a web link or on request, either electronically or as a paper document, using the email foi@anglia.ac.uk or the postal address below.  Please mark all requests with ‘FREEDOM OF INFORMATION – PUBLICATION SCHEME REQUEST’ so that they can be processed as quickly as possible. 

The information listed in the Scheme is available free of charge unless otherwise stated.  Multiple copies may be charged for depending on volume. Any charges will be notified to the requester prior to the information being provided. 

The information contained in the Scheme is divided into broad classes that are easy to understand.  This allows easier and quicker access to the required information.

Next to each class we have indicated the manner in which the information described will be available.  We have also indicated whether charges apply to material in each class.

Please note that a publication scheme relates to ‘published’ information. Therefore material covered has already been prepared in a format ready for distribution.

6. Information not included in the Scheme

6.1       With effect from 1 January 2005 members of the public have the right, under the Freedom of Information Act 2000, to request any information held by Anglia Ruskin University which it has not already made available through its publication scheme. 

6.2       On receipt of a written request (this includes fax and email), Anglia Ruskin University’s obligations under the Act will be met by informing any enquirer whether it holds the information in question and if it does, subject to exemptions, by supplying that information to the enquirer, or making arrangements for the enquirer to inspect the information, within 20 working days. 

6.3       Anglia Ruskin University will not release information if it is found to be covered by one of the 23 absolute or qualified exemptions.  We have to carry out a public interest test where a qualified exemption is concerned and must explain the reason for exempting the information to the requester.  Examples of possible exempt information include personal information (including details of members of staff, students or research subjects) the processing of which is covered by the Data Protection Act 1998 and information that might prejudice our commercial interests. 

6.4       The classes of information will not generally include:

  • Information, the disclosure of which is prevented by law, or exempt under the Freedom of Information Act, or is otherwise properly considered to be protected from disclosure.
  • Information in draft form.
  • Information that is no longer readily available as it is contained in files that have been placed in archive storage, or is difficult to access for similar reasons. 

6.5       If we rely on an exemption, then we will, within 20 days or any longer period permitted by regulations, provide the applicant with a refusal notice which:
           

  • states that fact;
  • specifies the exemption in question; and
  • states why the exemption applies (unless this is obvious)

This notice must:

  • contain particulars of any procedure provided by us for dealing with complaints about the handling of requests for information or state that we do not provide such a procedure; and
  • contain particulars of the right to apply for a decision by the Information Commissioner.

7. Feedback and review of the Scheme

Anglia Ruskin University will review the Scheme on a regular basis. Following each review it is expected that new information will be added to the list of current classes.  Anyone who is unable to find any information listed or who would like to provide feedback on the scheme should contact the University Records Manager at foi@anglia.ac.uk. All views will be considered during the review process as a means of improving access to the information within the scheme.

Complaints

If you feel dissatisfied with the outcome of a request, or the manner in which it was handled, you have the right to appeal against the decision.  You should write to or email the University Records Manager at the addresses above.  Receipt of the appeal will be acknowledged immediately and a more comprehensive reply shall be sent within 14 working days. 
If you are not satisfied with the reply and wish to complain, you should inform the University Records Manager within 14 working days.  The matter will then be passed to the Secretary & Clerk for review.  Receipt of the complaint shall be acknowledged immediately and a more comprehensive reply shall be sent within 14 working days.

Availability and conditions of use of facilities

Information in this class provides details about who can access systems and services and the facilities that they can access.  They provide assurance for external bodies/individuals that rules exist to ensure that breaches of conditions of use (e.g. breach of copyright, mail spamming of an external site are appropriately dealt with)

This class includes:

  • Opening hours of libraries, helpdesks, etc, scheduled maintenance times of systems
  • Who is allowed to use the facilities (e.g. categories of persons and their associated rights/levels of access)
  • The general rules and conditions of use (e.g. no smoking/drinking/eating, the existence of policies with regard to law such as copyright, computing code of practice, data protection.). For other student policies see reference to other relevant student policies in Publication Scheme.

 

Details of logging, monitoring and procedures followed in case of breach of conditions of use should also be included here.
